A jury sitting in Hamilton County Criminal Court deliberated about six hours over two days before finding a Harrison man today not guilty on one count of child rape and two counts of rape.
Jeffrey Mitchell Moore was accused of forcing a child, who is now 17 and not identified here in accordance with Chattanooga Times Free Press policy, to perform sexual acts on him since the child was 12.
Judge Doug Meyer said he disagreed with the jurys verdict. The judge addressed the defendant before he was released from the courtroom.
I sincerely hope you do benefit from this with the jury finding you not guilty, Judge Meyer said. They didnt find you innocent. They found that the state didnt prove its case.
Defense lawyer Jerry Summers said he respectfully disagrees with the judges assessment of the facts and praised the jurys ability to look past the emotions evoked in a child rape case.
