Judge rules some provisions of new methamphetamine law are constitutional

JASPER, Tenn. —; Marion County Circuit Court Judge Thomas Graham ruled today that some provisions of the new Meth Free Tennessee Act, challenged as vague and too broad, are constitutional.

“I don’t think this law is vague,” Judge Graham said in a ruling from the bench after hearing arguments for more than two hours. “It can be understood by persons of average intelligence.”

Judge Graham denied a motion filed last month by 12th District Public Defender Phil Condra to dismiss charges of promotion of manufacture methamphetamine against Gary Kouns, one of about 80 people charged in a May roundup.

Judge Graham said he would hear additional arguments July 20 pertaining to motions to dismiss charges against others charged in the roundup.
