Update: Petition seeks to suspend beer license revocation for Chattanooga's Club 2301

Club 2301 owner Charles Stearns has filed a petition in Hamilton County Chancery Court asking that today’s Chattanooga Beer and Wrecker Board’s decision to immediately revoke the club’s beer license be suspended until a trial.

The beer board revoked Mr. Stearns’ license after finding that he ran a disorderly business. Chattanooga police officers testified that the club had been the site of numerous violent incidents and drug deals since April.

The petition, filed through attorney Bill Pemberton, calls the action of the beer board “capricious, arbitrary, unlawful and without substantial and material evidence supporting it.”

It alleges that the decision will cause Mr. Stearns irreparable harm.
