Sam Parker’s lawyer asks for mistrial

Accused killer Sam Parker’s lawyer, David Dunn, asked Judge Jon “Bo” Wood today to declare a mistrial after Theresa Parker’s pregnant niece gave tearful testimony.

Mr. Dunn told Judge Jon “Bo” Wood that District Attorney Leigh Patterson was trying to “provoke an emotional response” by showing Mrs. Parker’s niece Arica Patterson a photo of her missing aunt.

Mr. Parker is charged with murder in the death of his wife, who last was heard from on March 21, 2007. He has pleaded not guilty in Walker County Superior Court in LaFayette.

Mr. Dunn said Mrs. Patterson broke down crying, but Judge Wood did not agree and said Mr. Dunn was exaggerating. He denied the defense’s motion.

District Attorney Patterson questioned two of Mrs. Parker’s nieces about their experiences with Mr. Parker. The defense did not cross examine them. The district attorney also questioned Mrs. Parker’s sisters, Christina Hall and Hilda Wilson.

Mrs. Wilson testified about domestic disputes she said occurred between Mr. and Mrs. Parker.
