Chattanooga: Court date moved for men charged with civil rights intimidation

A court date has been moved to Aug. 12 for three men accused of throwing lit fireworks and shouting racial slurs at a public housing complex.

Colton Partin, James Smiley and Kyle Montgomery reportedly threw the fireworks toward East Lake Courts early in the morning of July 9. They now face charges of civil rights intimidation.

“I don’t think it’s a question of whether or not there were fireworks. I think it’s a question of whether or not there is a civil rights issue,” said Lee Davis, a defense attorney, representing Partin.

The local NAACP has called for a federal investigation.

Additional charges likely will be filed against the men on the state or federal level, according to Chattanooga police spokeswoman Sgt. Jerri Weary. Further investigation into the incident "has produced new evidence that speaks to the very nature of the crime and the severity of how dangerous the act was," she said in a news release.

In General Sessions Court Judge Clarence Shattuck’s courtroom today, prosecutors asked for the court date to be moved to collect evidence and plan to make surveillance footage at East Lake Courts available for attorneys to review.

NAACP should be hiring Sherrie Gilchrist. She sure knows how to advance colored people.

What these three did goes much deeper than some idjits out on a drunken prank call. The Chattanoogan news story is much more detailed.

"He said they are shown with fireworks similar to a Roman Candle. "Instead of aiming it in the sky like you are suppose to, they aimed it at the building," he stated.

Chief Dodd said a large explosion is shown going off within feet of one person with several others nearby on a porch.

He said, "It was an unbelievable explosion. I've never seen anything like it before."

Chief Dodd added, "It is a terrible situation where someone could have been hurt or killed. We are not going to tolerate that in this community."

He said he is waiting to see if federal authorities are going to take the case prior to releasing copies of the video.

He said if there is no federal prosecution, he will then immediately release the video and seek to upgrade the charges to aggravated assault or possibly attempted murder.

Chief Dodd said the trio was arrested nearby by an off-duty city police officer who was on his way home from a second job.

Prior to the press conference, police said, "Further investigation into the matter has produced new evidence that speaks to the very nature of the crime and the severity of how dangerous the act was." <

Hopefully, their lives won't be ruined over this. However, some stiff measures need to be taken against them and others who might want to emulate them that this type behavior won't be tolerated.

Hes got to be talking about the mortars. Those things pack an incredible punch, and can kill or mame. If it is, those guys are in some deep crap. These are the big boy fireworks you see at 4th of July fireworks shows.

They are out on bond Eastridge8, but I would assume they will be arrested again on some felony counts very soon. Possibly some Federal explosives charges.

This is TYPICAL...Personally I KNOW 3 people that had to leave University of Tenn CHATT..because a gang...of black boys were threatening harrasing/provoking them.My cousin had his family call and was told by the staff that happens alot, but there was nothing they could do but file a complaint. IMAGINE if that was turned around...would have the national guard down here and calling the race card. Sooooo sick of the NAACP and there bullying.What would happen if we created our own "group" "it would be UNCONSTITUTIONAL" sickens me..these boys didnt use there best judgement and someone saw the opportunity.

Young and stupid is no exception for BREAKING the LAW.

If a tree falls in the woods and nobody hears it..... Did it still make a sound?
If you run a stop sign and nobody witness it was the LAW still broken?

IT IS WHAT IT IS....... They should be charged with a federal crime just for the nature of the crime against peacefully people minding their damn business between 2 - 3 in the early morning hours. 3 drunk stupid a$$ white boys.

It is possible they could have done something to enhance the explosion of the roman-candle. Also, another news station stated they did have a gun and ammunition in the vehicle when stopped. If they had plans to use that too no one's sure. Thank goodness that off-duty officer on his way home from a second job stopped them before they had a chance to do more harm.

when I was growing up we used to have roman candle fights all the time.If it was truly a roman candle this is being very blown out of proportion.But I have come to expect that from certain orgs.

What orgs are you referring to? The Chattanooga Police Department org? The Chief of Police? From what the chief has stated these individuals may have added something to the roman candles that caused them to have an enhanced explosion than a normal roman-candle would have. Plus, when stopped, there was a gun and ammunition. Looks like these 3 might have had something more in mind than just throwing fireworks. Who knows what else they may have done if that off-duty police officer hadn't been on his way home from another job and caught them?

Where was the laughing and smiling today? If the video hadn't surfaced these "Young Dumb white boys" would have escaped these charges.

"Everyone is just blowing this out of proportion" Wow...now the lies are being EXPOSED...Like the old folks say sometimes if you sit back long enough PEOPLE WILL HANG themselves. Especially, when you have ZERO remorse.
