No charges will be filed against a motorist whose vehicle struck a pedestrian Friday night, Chattanooga police said.

According to a news release, 31-year-old Shavaun R. Atcitty was trying to cross the 6200 block of Lee Highway about 8 p.m. when he walked in front of an eastbound vehicle driven by Robert McMinn.

The driver and his wife told police they did not see Atcitty, who was wearing dark clothing.

Atcitty was listed in stable condition in a local hospital, police said.
