A suspended Chattanooga fire captain must stay out of trouble for one year to have his assault charge dismissed.

David Lebron Brooks, Jr., 40, was arrested following a fight with his daughter, Jasmine Brooks, 21, after police say the pair got into a scuffle that ended up on the floor.

Hamilton County General Sessions Judge Clarence Shattuck today allowed a plea agreement to suspend the sentence rather than impose jail time. If Brooks has no other criminal charges in the next year, the charge will be dismissed.

Shattuck preserved a "no-contact order" for Brooks, preventing him from interacting with his daughter during the period he's under court control this next year. He also set a Sept. 20 check-in date to ensure compliance and ordered David Brooks to pay uncovered medical expenses for his daughter related to the assault.

During the incident, Jasmine Brooks sustained a laceration to her head, while her father had scratches on his face, according to an arrest report.

Following the arrest, David Brooks filed a temporary protective order against his daughter. In exchange for the suspended charge, he agreed to drop the protective order against his daughter.

He was placed on paid leave from the fire department on June 4, one day after his arrest. He and Jasmine Brooks are free on a $500 bond each.

David Brooks had previously been demoted from fire marshal to captain in 2010 after an internal affairs investigation deemed he'd acted inappropriately with another firefighter's wife.
