Victor Chaves Santay

A 42-year-old man faces charges of child rape after performing oral sex on an 8-year-old girl, according to a Chattanooga police report.

Victor Chaves Santay was booked into the Hamilton County Jail on a $50,000 bond Wednesday.

Santay was arrested after the girl was admitted to Children's Hospital with lesions around her genital area resulting from contracting herpes, an affidavit of complaint states.

Santay was in charge of watching the child on several occasions when he performed the sex acts on the child, according to the complaint.

In interviews with police, Santay denied any inappropriate contact with the girl stating that he only kissed her on the lips briefly, hugged her and kissed her on the neck.

When the child was talking with investigators, she was asked to draw pictures of herself and Santay. She drew what happened to her, according to the affidavit.

Santay's next court date is set for July 10 before Hamilton County General Sessions Court Judge Clarence Shattuck.
