MILLBROOK, Ala. - A police chief says the death of a 2-year-old boy struck by a car outside his family's apartment near Montgomery appears to be a "horrible accident."

WSFA-TV reports the toddler died Sunday after he was hit late Saturday after wandering onto Deatsville Highway. Millbrook police are investigating.

Police say the driver spotted the child in the road and tried to brake and swerve, but still struck him. Police did not release the boy's name.

Police Chief P.K. Johnson says the toddler appears to have wandered from a nearby apartment without his mother knowing. He said the driver wasn't impaired by drugs or alcohol, and investigators don't believe excessive speed was a factor. Based on those findings, Johnson says he does not expect charges to be filed against the driver.
