Man unhurt, arrested after Dalton police fire at him for pointing BB rifle at officer

Baldemar Jaramillo-Garcia, 20, was arrested by the Dalton Police this morning after he pointed a weapon at an officer, and the officer subsequently shot at him through a second floor window, according to a news release from the police department.

An officer was driving by the townhouse apartment where Jaramillo-Garcia lived, at 205 Cappes Street, when a woman on the street flagged the officer down and told him a fight was taking place at the residence.

The officer arrived at approximately 8:30 a.m., and found Jaramillo-Garcia and a woman in a physical fight outside of the residence. Other officers began to arrive on scene, and Jaramillo-Garcia was given verbal commands to surrender, according to police.

Jaramillo-Garcia, wearing a ballistic bulletproof vest, told officers to shoot him and refused to surrender, before running inside the residence and to an upstairs window.

Police said Jaramillo-Garcia appeared in the window pointing a rifle-style BB gun at an officer, who fired once at him, hitting near the window.

Soon after this, Jaramillo-Garcia came out of the front door uninjured and surrendered without further incident, police said.

During this time, officers were able to get the woman and her two children out of the apartment and safely away from the building.

Jaramillo-Garcia was immediately taken into custody, and has been charged with aggravated assault on a law enforcement officer, reckless conduct, cruelty to children in the second degree, and making terroristic threats, according to police.

By department policy, the Dalton Police Department has called in the Georgia Bureau of Investigation to assist with the investigation of the incident and the shooting.
