No charges in police raid that hurt toddler - and more Chattanooga region news

ATLANTA- A grand jury in northeast Georgia has recommended that no charges be brought against officers involved in a raid on a home that seriously injured a toddler when a flash grenade detonated in his playpen.

WSB-TV reported the grand jury made its recommendation Monday.

Bounkham Phonesavanh was 19 months old at the time of the raid in late May. Family members have said the boy has undergone numerous surgeries.

Members of a law enforcement task force looking for a drug suspect threw the flash grenade into the home where the boy was staying while executing a search warrant. The suspect they were seeking was not in the home at the time.

Mawuli Davis, a lawyer for the family, said he needed to talk to his clients before commenting.

City wins fight over strip club

BROOKHAVEN, Ga.- Georgia's highest court has ruled a city can ban adult entertainment businesses that sell alcohol.

In a unanimous opinion published Monday, the Georgia Supreme Court upheld a DeKalb County court's dismissal of a lawsuit filed against Brookhaven by the Pink Pony strip club.

The strip club argued the city's new ordinance banning nude dancing in places where alcohol is consumed unconstitutionally violates free speech.

Justice Harold Melton wrote in the opinion that given "the established record regarding the deleterious effects of alcohol coupled with nude dancing," the ordinance does not infringe the club's free speech rights.

The Pink Pony has been in business for 22 years and had reached an agreement with DeKalb County allowing it to operate. A month after incorporating in December 2012 Brookhaven passed its ordinance.
