MACON, Ga. - A Georgia Superior Court judge could face charges after he was given a breath test for alcohol during a traffic stop.
The Telegraph of Macon reports Bibb County Superior Court Judge Howard Simms says he entered an in-patient alcohol treatment facility after being stopped Sept. 22. Bibb County sheriff's investigators say the judge's blood-alcohol level was .083. That's above the legal limit but Simms wasn't arrested and was allowed to continue home.
Chief Deputy David Davis says results of an internal investigation are expected Monday and will be made public after Sheriff Jerry Modena reviews the findings. Simms could also face sanctions by the state Judicial Qualifications Commission.
The judge said in a statement he has struggled with alcohol addiction for years.
