Alabama judge considers bid to close abortion operation

BIRMINGHAM, Ala. - A state court judge is hearing testimony on whether to shut down an abortion facility in Birmingham.

Circuit Judge Joseph Boohaker is considering the state's claim that a doctor is performing abortions at an illegal clinic that doesn't have a license.

The former owner of the clinic, Diane Derzis, testified today that she doesn't have anything to do with the operation aside from renting a building to an abortion doctor.

Derzis was in charge when the clinic was cited for numerous health violations last year and gave up the clinic license.

State attorneys argue Derzis is still involved and want the facility closed.
