MEMPHIS, Tenn. - A court hearing to determine if a former prison guard is eligible for the death penalty on charges he killed two Tennessee postal workers is set to resume, a day after he had to be restrained and removed from the courtroom.
Chastain Montgomery returns to court today for a hearing to determine if he is intellectually disabled. He has pleaded not guilty to fatally shooting Paula Robinson and Judy Spray during a robbery at a small-town post office in October 2010.
The U.S. Supreme Court has ruled that intellectually disabled federal inmates cannot be executed.
On Monday, Montgomery became upset during his mother's testimony. He abruptly stood up and began to speak before being grabbed by U.S. marshals and forced into a room adjacent to the courtroom.
