Mistrial motion denied in Krystal slaying trial in Alabama

DECATUR, Ala. - The judge presiding over the trial of a 23-year-old man accused of fatally shooting two Krystal restaurant employees has denied his attorney's motion for a mistrial.

Jordan Creque was to be sentenced Monday but his attorney requested a mistrial after learning a juror spoke with a police sergeant who served as a witness for the prosecution.

The judge interviewed both and determined that their discussion, which unfolded in a store over the weekend, wouldn't compromise the outcome of Creque's sentencing.

Creque was charged along with two others in the deaths of two Krystal employees. Investigators have said the victims were killed during an armed robbery. Creque's co-defendants have yet to go to trial.

Creque was convicted of capital murder Friday and faces a life sentence or the death penalty.
