At around 11:30 a.m. Wednesday, Athens Police Department Officer Harold Thompson spoke with members of the Athens Housing Authority's Clem Jones Apartment Complex maintenance crew who said that they had just spotted some marijuana in one of the apartments. The maintenance workers said that they had been called out to Apartment 28 to fix a broken toilet and had "seen what they believe to be marijuana sitting around the apartment."

With that information, Thompson went to the apartment and spoke with the tenant - identified as Andrew Cole Sampson, 18, of Athens - and two of his friends. When Thompson told Sampson the maintenance workers had spotted the marijuana, Sampson responded "he threw the stuff into the trash bag."

Sampson then gave Thompson consent to search the apartment and the officer asked Sampson if he could pass a drug test. Sampson reportedly replied that he could not, though he said he hadn't smoked any weed since Tuesday.
