The case of Robert "Bobby" Stone, husband to one of Mayor Andy Berke's senior advisers, may not be worked out until the Tennessee Bureau of Investigation finishes probing a domestic violence episode that sparked allegations of an inappropriate relationship between Berke and his senior adviser.
Attorneys today asked Hamilton County Judge Lila Statom to give Stone a new court date during his first appearance.
Statom agreed to the request and set a hearing on Aug. 9.
A spokeswoman for the district attorney's office said prosecutors cannot comment on a pending case.
Stone's attorney, Lee Davis, had no immediate comment.
The domestic incident happened earlier this month around 11:30 p.m. Lacie Stone, one of Berke's top advisers, told police she and her husband argued over her phone. Bobby Stone told investigators that he dragged her by the belt to the door of their home in North Chattanooga and told her to leave, records show.
During the disagreement, Lacie Stone said her phone was crushed. She tried to keep the phone, hitting her husband in the forehead with it during the struggle, records show.
Then she got into a vehicle and started to leave home when her husband threw a rock into the back windshield, shattering it, according to a police report.
She then called Chattanooga Police Department Chief Fred Fletcher, who confirmed last week that she went to his house.
Soon after, Berke publicly denied allegations that the domestic violence stemmed from an affair between himself and Lacie Stone.
Still, the incident prompted District Attorney General Neal Pinkston to request the TBI to investigate.
Last week, a TBI spokesperson declined to release any details about the scope of the investigation.
"The investigation is active and ongoing and we have no additional detail to offer at this time," spokesman Josh DeVine said in a statement.
