Judge in Pilot Flying J fraud case shores up appellate record in sentencing order

A federal judge who helmed the fraud trial of the former president of the nation's largest diesel fuel retailer is publicly addressing appellate jitters over his unusual order instructing prosecutors to rank the fraudsters by level of guilt in the scheme.

In a lengthy scheduling order filed this week, U.S. District Judge Curtis L. Collier put on paper a defense to any appellate attack on his request for a prosecutorial ranking of former Pilot Flying J President Mark Hazelwood and 16 subordinates.

He made clear that each of the 17 former employees of the truck stop giant would be judged individually without regard to the ranking.
