Polk County man charged in Sunday shooting

A Polk County, Tenn., man has been charged with attempted murder while another is recovering from a gunshot wound to his back after a fight Sunday in Copperhill, authorities say.

Shane Stuart, 38, is charged with attempted first-degree murder, unlawful possession of a weapon and possession of a firearm during the commission of a dangerous felony, records state. He remains held without bond in the Polk County Jail.

Stuart is accused of shooting local resident Darian Self once in the back on Sunday after the two got into a heated argument. Self last was reported in stable condition, Polk County Sheriff's Office Detective Kevin Cole said Tuesday.

The men got into an argument Sunday afternoon over a woman, Cole said.

The shooting happened at Wally Dean's home at 148 Creme St. in Copperhill, according to a report by Deputy Mike Mull.

Dean, his unnamed girlfriend, Stuart, Self, Shannon Stuart and Marcus Payne Jr. all were present at the home when words led to shots, Mull said in the report.

When the argument between Stuart and Self started becoming physical, Dean told them "they needed to take it outside," Mull said. The two men stepped outside and "argued a moment" before Stuart drew a weapon, the report states.

"Wally stated that Shane pointed the weapon at Darian and that Darian raised his arms above his head and turned his back to Shane and stated that if he was going to shoot him that he would have to shoot him in the back," Mull states. "Wally said as Darian finished saying 'shoot me in the back,' he heard the weapon discharge and that Darian screamed out, 'He shot me,' and that he fell to the ground."

According to the report, Stuart then knelt over Self, apparently to shoot him in the head, when Dean kicked the gun away, saying to Stuart, "Are you crazy, man?"

Authorities said Self had an entrance wound in his back and an exit wound in his lower right abdomen.

Cole said Tuesday that a 9 mm semi-automatic handgun was found in Stuart's possession when he was arrested. Stuart has not given a statement, he said.

Stuart will be arraigned in Polk County General Sessions Court today, officials said.
