Yes, the jury made an award but I'm sure when the appeal is granted, the "new" jury will see just how excessive the amount was and reverse it as a panel of objective citizens should. I understand there are alot of people out there who feel the healthcare system is not "working" and there needs to be a change. But to make an example of a doctor who performed the "test", discharged the patient with instructions on when to proceed to an ER (every patient is given post procedure instructions upon leaving the office)and placed his confidence in the patient to follow the guidelines that would help patients or their families to seek emergency medical attention if symptoms presented themselves, then hold "him" responsible when she experienced the emergency symptoms and did not seek emergency medical attention. But to call the doctor again and expect to be diagnosed over the phone (much like buying a pig in a poke) and wanting a miracle cure. I'd rather sit in the emergency room with a questionable emergency than stay at home and possibly worsen or die.

I work in the medical field and to be honest I've never understood how people think any physician can diagnose and treat a patient over the phone. I have seen patients who will be having an acute MI , exhibiting all symptoms, call and want to know what to do. Please, someone needs to tell patients if you are bleeding from an area you usually don't, having pain where you've not before, or can't breathe go to an emergency room after office hours. I hate to think persecution of this wonderful doctor will open the doors for many other lawsuits now. Because, does anyone know what she said to the office when she called in? Was she specific in her symptoms and signs or did she just say I have some vomiting? I think Dr Goodman should appeal this verdict becuase patients should be held 99 percent responsible for their care when they are at home.
