An Alabama man is in jail in Calhoun, Ga., on child abuse charges after his year-old daughter was hospitalized with a leg injury.

Cody Gibson, 18, of Fort Payne, Ala., is charged with three counts of felony cruelty to children and one count of felony aggravated battery, according to a news release from the Calhoun Police Department.

The incident happened on the night of Aug. 5, when officers were called to the Hi-Tech Fuel gas station regarding an injured child. Police were told the child had been taken to Hamilton Medical Center in Dalton for treatment.

The officers met with Cody Gibson, who identified himself as the child's adoptive father. He told officers may have slammed the child in her car seat a bit too hard and caused the injury.

"At this stage in the investigation the evidence points to intentional excessive force inflicted on the child by Gibson as the cause of the injury," Chief Tony Pyle said.

It wasn't clear from the release whether Gibson had yet had bond set or retained an attorney.
