Red Bank city commissioners passed two ordinances relating to short-term rentals by a 4-0 vote at their July 3 meeting. Commissioner Ed LeCompte was not present.
The ordinances were expected to pass on the final vote scheduled for the commission's July 17 meeting.
One of the ordinances establishes regulations for short-term rentals, including permitting and inspection requirements. It requires owners to file an application for a permit that must be renewed annually. The permit would not automatically transfer to a new owner if the property is sold, said City Attorney Arnold Stulce.
The ordinance also requires short-term rental units to have functional smoke detectors and to comply with all applicable health, safety, housing, building and zoning laws.
Other restrictions established through the ordinance include limiting the number of rooms available for rent to five and limiting the number of people per room to two.
The companion ordinance establishes the city's commercial zones and R3 and R4 special residential zones as permitted zones for short-term rentals.
Mayor John Roberts said there are certain aspects of the recently passed state legislation concerning municipalities' ability to regulate short-term rentals that the city is still trying to resolve, such as whether it can charge a hotel/motel tax.
"This is a process," he said, adding that if commissioners decide any aspect of its two short-term rental ordinances isn't working, it can always be changed.
