The Chattanooga firefighter who was hit by a passing car last week is recovering from his injuries.

Lt. Larry O'Rear was struck Feb. 1 by a red Mercedes-Benz while helping to direct traffic at the scene of a crash on East Brainerd Road.

The woman identified as the driver of the car, Andrea Leeanne Payne, was indicted by the Hamilton County Grand Jury Wednesday, according to a news release from the Chattanooga Police Department. Payne was charged with DUI and leaving the scene of a crash, as well as vehicular assault, failure to render aid and failure to maintain lane.

Payne said she didn't see O'Rear. Her car struck him, sending O'Rear over the passenger side of the vehicle.

Chattanooga Fire Department spokesman Bruce Garner said O'Rear's injuries were serious, but not life-threatening. Hamilton County Emergency Services took him to Erlanger, where he was said to be in stable condition.

Garner said that O'Rear has decided to let the Chattanooga Police Department comment on anything pertaining to the case.
