Victim in Moccasin Bend attack dies; suspect now charged with murder

The victim of an attack at Moccasin Bend Mental Health Facility has died, causing charges against the suspect to be increased to first degree murder.

Hamilton County Jail inmate Leviticus Avery, 37, was also charged with aggravated assault.

On Oct. 7, Kevin Green, 38, was struck in the head with an object and taken to a local hospital by a family member. He later died.

Avery has a long rap sheet including charges of car jacking, aggravated domestic assault and aggravated burglary. 

Avery was in jail awaiting a Nov. 4 court date for aggravated assault and vandalism charges filed on Aug. 26, according to the Hamilton County Court's website.
