Hixson man charged with aggravated domestic assault after firing gun during dispute

A Hixson man was arrested early Monday morning after a domestic dispute turned violent.

Hamilton County sheriff's deputies were called to the 7700 block of Gann Road around 1:18 a.m. where they spoke to 32-year-old Marcus Rutherford and a woman who said she was attacked by Rutherford, according to Hamilton County court records.

Rutherford told deputies the woman came to his house to have a discussion.

He said she "attacked him and brutal [sic] beat him while destroying the house," court records state. He said that, at one point, he had to hide under his bed until she "grabbed him and dragged him through the house, out the front door, and down the front steps."

Rutherford got away and ran back upstairs where he grabbed a 9 mm pistol and fired one shot into the floor "to scare her off," he told deputies.

The woman had a "very similar version of the story but insisted she was the one attacked, beaten and dragged around," a deputy noted in Rutherford's arrest report.

Rutherford had no visible injuries, "that most definitely would've been present if his version of events were true," deputies noted. But the woman, on the other hand, had "cuts scratches and bruises all over her body which is very consistent with her version of events."

She was taken by ambulance to a local hospital for treatment, and Rutherford was taken to the Hamilton County Jail where he was charged with felony reckless endangerment and aggravated assault.
