A 24-year-old man is in custody after shooting a man who was running away from him last month, police say.

Chattanooga police were called to an apartment complex in the 1900 block of Maple Hills Way just before 7 p.m. on Nov. 19. When they arrived, they found a 36-year-old man with a life-threatening gunshot wound to the face, according to Hamilton County court records.

The man was rushed to a local hospital for treatment. His current condition is not known, and police have not released his identity.

Investigators arrived at the scene shortly after receiving the call and began collecting evidence and gathering witness statements.

The next day, investigators spoke with a witness who said the victim had not been taking his medications and was convinced that a neighbor's boyfriend - later identified as Markious Sims - had become involved with a family member, according to court records.

The witness told police the victim had left the house just minutes before hearing a gunshot, and security footage showed a black Chrysler 200 driving the wrong way out of the complex around the same time.

Police determined Sims had access to a black Chrysler 200 and spotted one parked in the back of the apartment complex, not too far from where the crime scene was, court records show. Investigators then obtained a search warrant for the vehicle on Dec. 3 and found Sims' fingerprints inside.

By Dec. 7, police interviewed Sims. He claimed the victim approached him and "verbally assaulted him," court records state. That's when Sims pulled out a gun, he told police. And as the victim began to run away, he fired a single round.

Police asked Sims why he pulled the trigger if the victim was running away. "He stated he did not know," an investigator wrote in the criminal affidavit.

Sims was booked into the Hamilton County Jail that day and is being held on a $390,000 bond. He is charged with attempted criminal homicide, aggravated assault and possession of a firearm during the commission of a dangerous felony.

And because Sims is a convicted felon, he has also been charged with unlawful possession of a weapon, as Tennessee and federal law prohibit felons from carrying firearms.

Chattanooga police ask anyone with information regarding the incident to call 423-698-2525 or submit a tip via the CPD Mobile App. Tipsters can remain anonymous.
