Attempted first-degree murder charges against Darrius Harris were dropped Tuesday.

Harris, 19, who police say is a validated member of the 52 Hoover Crips, was charged in April in an attack that dates back to December 2014.

Dartagnan Rollins said he was walking with another man on West 38th Street last year when a car rolled by and several shots rang out. Though Rollins reported he didn’t see the shooter, the other man identified him as Harris.

On Tuesday, prosecutors said that wasn’t enough. They dismissed charges of attempted first-degree murder, aggravated assault, reckless endangerment and possession of a firearm in the commission of a felony for lack of evidence.

Harris will remain in jail, though, because he’s still facing charges in Hamilton County Criminal Court of aggravated robbery, possession of a dangerous weapon and theft of property.
