A third lawsuit in recent months against Life Care Centers of America, alleging the company owes unpaid overtime, was filed in Chattanooga federal district court.

The filing asks the court to force the Cleveland, Tennessee, long-term care provider to recognize the lawsuit as a class action, pay all uncompensated overtime hours, reasonable attorneys’ fees and any further relief deemed appropriate.

Filed on behalf of Ashley Allison, an employee of the company’s facility in Altamonte Springs, Florida, the lawsuit said employees received additional wages for working less-than-desirable shifts, like nights. However, when overtime rates were calculated, the company allegedly did not properly include wages for those shifts.

In the two other lawsuits filed against the company, employees from Tennessee and Indiana facilities also accused the company of requiring off-the-clock continuing education and compliance training, which would take between three and eight hours to finish.
