At least three lawsuits have been filed against a Chattanooga Massage Envy franchise since late December, court records showed, and more lawsuits are on the way after a former massage therapist admitted to recording clients inside private session rooms.
Former Massage Envy client and Ooltewah resident Kendra Sylar is suing Massage Envy at Hamilton Place, franchisee Brooke Goodyear and Goodyear’s former employee, Kenneth Spears, for up to $325,000 in a medical malpractice lawsuit. The lawsuit claims include, but are not limited to, invasion of privacy, negligent supervision and intentional infliction of emotional distress.
Sylar remains afraid that the illegally captured videos and photos of her were posted on the internet or remain on Spears’ devices, according to the lawsuit. The filing also asks the court to bar the former employee from having or copying the content and to itemize all material in his possession or posted online.
The local business owner, Goodyear, immediately fired Spears after learning in September that he had allegedly filmed a client, according to an earlier statement from the business. A spokesperson for the business said by email that since the day Goodyear was informed of Spears’ activities, she has fully cooperated with law enforcement and prosecutors.
