A court-ordered mediation in the $20 million lawsuit against local health food store Nutrition World resolved no issues in the case, according to Hamilton County court records.

Michael Mallen sued Nutrition World and owner Edward Jones in May 2025, alleging Jones, also known as Dr. Mustache and Captain Wellness, profited by fraudulently diagnosing Mallen’s wife and selling her over $200,000 in snake oil cures.

The defendants have asked a judge to dismiss Mallen’s medical malpractice complaint, arguing in a motion that Mallen cannot sue over injuries allegedly suffered by his wife and has not made a valid legal claim of his own.

Mallen never alleges he took any of the supplements or other products he claims were harmful, according to a defense motion. Meanwhile, the filing said, his wife has stated she experienced no injury as a result of her supplement regimen.

The attorneys for the defense, Alaric Henry and Allison Cyrus-Walker, also argued Nutrition World and Jones are not health care providers and therefore cannot be held liable for medical or pharmacy malpractice.
