Two members of the Walker County school board are ineligible to serve because they have children who work as administrators in the school system, a lawsuit claims. A Superior Court judge will hold a hearing on the case this month.

The two-page filing was brought in September by Chelsea Cagle, a resident of Walker County and parent of a Walker County Schools student, against Board Members Mike Carruth and Karen Harden.

The filing, called a quo warranto, quotes Georgia Code 20-2-52(4)(A), which says, “No person who has an immediate family member … serving as … system administrative staff in the local school system shall be eligible to serve as a member of such local board of education.”

In Latin, quo warranto means by what right, or by what warrant, according to John Monroe, the Lumpkin County-based attorney handling the case for Cagle.
