The final path to keep the 2014 Gilmer County, Georgia, alleged rape case moving toward a possible trial for criminal charges has expired.

Prosecutors did not appeal a judge’s dismissal of charges against the three former Calhoun High School students after previously considering it, according to Frank Wood, the top prosecutor serving Gilmer, Fannin and Pickens counties in Northwest Georgia.

“I wanted this victim to have her day in court,” Wood said by phone. “I wanted to be able to take this case to trial, let her have her day in court, and let the people decide on this matter.”

Despite his office’s best efforts, Wood said, prosecutors were unable to contact the accuser for her input before the appeal deadline, June 10. He also said winning the appeal would be challenging and that his office would be unable to prosecute without her.
