A Cleveland doctor has signed a plea agreement saying he billed Medicare nearly $7.5 million for phantom Botox injections.

According to the U.S. attorney’s office for the Eastern District of Tennessee, the agreement says 44-year-old Raymond Brown billed Medicare for more than 17,700 vials of Botox between 2008 and 2012. During that time Brown did not purchase any FDA-approved Botox and purchased only 245 vials of non-FDA approved Botox.

Brown pleaded guilty on Friday to using misbranded drugs with the intent to defraud Medicare.

Sentencing is March 5 in Chattanooga. He faces up to three years in prison plus fines.

As part of the plea agreement, Brown will forfeit more than $6.7 million seized from his bank accounts and pay a judgment of more than $717,000 in cash.
