Hamilton County Juvenile Court Judge Suzanne Bailey on Thursday scheduled a Sept. 9 hearing to decide if two suspects in the shooting death of a 21-year-old man will stand trial as adults.
At the transfer hearing, Assistant District Attorney H.C. Bright will argue that Franklin J. Wood Jr., 17, and Dominique Montel Greer, 18, should be tried as adults on charges of felony murder and aggravated robbery.
Bright alleged in court Thursday that Greer and Wood attempted to rob Darrian Moore while he was sitting in the driveway of his parents’ Shady Hollow Lane home in Harrison on July 21.
Moore was shot in the head and died shortly afterward at Memorial Hospital.
“Mr. Greer did the actual physical killing,” Bright said in the hearing.
Bright and Martin Levitt, Wood’s attorney, disputed whether Wood can be charged in connection with the death. Investigators say he planned the robbery but did not pull the trigger.
A separate hearing on Aug. 19 to argue that charge will not affect the Sept. 9 transfer hearing.
Levitt and Greer’s attorney, Stephen Jones, requested that their clients be released to their parents’ custody. Bailey denied the request.
Wood and Greer arrived in the courtroom wearing jail jumpsuits, their hands and feet shackled.
Greer turned 18 while in custody and is being held at the Hamilton County Jail. Wood is being held at the Hamilton County Juvenile Detention Center, officials said.
Family members for both suspects were present at Thursday’s hearing but declined to comment.
There did not appear to be any members of the Moore family present.
