Recall decision expected this afternoon

A decision on whether the effort to recall Mayor Ron Littlefield will be allowed to proceed is expected at about 2:30 p.m.

A hearing over Littlefield’s attempt to block the recall effort got under way at 9 a.m. today in Hamilton County Circuit Court Judge Jeff Hollingsworth’s courtroom.

Attorneys for Littlefield, the city, the Hamilton County Election Commission and recall petitioners met to discuss facts of the cases during a brief recess.

The courtroom was packed with media, citizens and petitioners.

Littlefield’s attorney, Hal North, raised several key questions, including the number of signatures needed, whether state law trumps local law and whether the recall petition poses a question for a ballot.

The election commission is asking the judge to rule today and issue a declaratory judgment.

Recall attorney Joe Manuel asked the judge to consider the more than 15,000 voters who signed the petition when deciding whether technicalities in the law should undo their efforts.
