Citing ‘rambling document,’ judge drops Walker County’s lawsuit against Erlanger

A federal judge has dismissed Walker County’s lawsuit against Erlanger Health System.

In an order Monday, U.S. District Court Judge Harold Murphy wrote that the local Georgia government did not offer convincing evidence that Erlanger intentionally killed Hutcheson Medical Center and deprived the county’s residents of health care. Murphy also ruled against the county’s request to protect the local government from Erlanger’s own lawsuit, in which the Chattanooga hospital is asking for about $8.7 million.

Murphy called Walker County’s motion “a rambling document that essentially consists of a collection of legal arguments. It contains few, if any, factual allegations.”

Stuart James, the Chattanooga attorney hired to represent Walker County in this case, did not respond to a call or an email seeking comment Tuesday.
