Hamilton County Circuit Court Judge L. Marie Williams ordered the case dismissed, finding that Pamela Shumake did not violate her CHA lease when the guest unknown to her had the drug on him.

Shumake testified in a previous Sessions Court hearing that while she was away from her College Hill Courts apartment Darryl Jones visited her husband at the apartment. When she returned she called police about Jones, who then arrested the man for marijuana possession.

Shortly afterward CHA used its “one-strike” eviction policy to remove Shumake. After the Sessions Court ruled she had violated the lease regarding criminal activity she appealed to the Circuit Court.
