McMinn woman kills husband, police say

Robert Vann Marshall, 34, left the McMinn County Jail on Saturday after being arrested on firearms and narcotics charges and served with an order of protection filed by his wife.

The time was about 1:30 p.m.

Eleven minutes later, McMinn County 911 dispatchers received a call from Melissa Marshall, who said Robert had returned to the residence -- a violation of the order served on him -- and was trying to force his way into their Velma Road residence.

As she spoke with dispatchers, she indicated that her husband had forced his way into the home and that she had shot him, according to a news release from the McMinn County Sheriff's Office.

Athens police and McMinn County sheriff's deputies responded to the call and found the front door forced in and Robert Marshall "lying in a back bedroom of the residence with a fatal gunshot wound to his chest," the sheriff's office said.

"[I]n light of all evidence, no charges were filed against Melissa Marshall," said Sheriff Joe Guy in the release. "In cases where it appears that self-defense took place, we will work with the district attorney general's office and make a decision whether or not [to] present it to the grand jury."

An investigation is under way.
