A man accused in a civil lawsuit of raping a woman during a fraternity party at The University of Tennessee at Chattanooga earlier this year says in a court filing the two had a sexual encounter that was consensual.

The fraternity, which is also named as a defendant, says in recent court filings that the woman's lawsuit is not valid because her claims are not federal violations. The woman says in her lawsuit that the fraternity, the Delta Epsilon chapter of Pi Kappa Alpha, had a duty to keep her safe and failed to do so, leading to the incident.

The man, who lives in Nashville, denies any wrongdoing and instead claims the woman who filed the lawsuit is trying to slander him and harm him by making false claims, according to the response filed in court by his attorney, Lee Davis of Chattanooga, on Dec. 4.
