A man accused of knowingly infecting his pregnant wife with HIV had his court date moved to Sept. 9 after he told attorneys he plans to hire a private defense attorney.

James Hutchins, 46, posted a $10,000 bond and was seated in General Sessions Court David Bales courtroom Tuesday morning.

Hutchins was previously convicted of criminal exposure of HIV in 1999. If convicted a second time for the same offense, Hutchins could be sentenced between three and six years for the charge, which is a Class C felony.

Hutchins' previous sentence was six months' incarceration and five years' probation.
