A man is facing attempted murder and assault charges after allegedly threatening his ex-girlfriend with a samurai sword and shooting her brother at a Hixson home, according to police.
David J. Smith, 43, was arrested Monday on Crescent Club Drive and charged with one count of attempted first-degree murder and two counts of aggravated assault after he allegedly threatened to kill his former girlfriend and mother to their son at her home at the 5800 block of Taggart Drive, according to a sworn affidavit from the Chattanooga Police Department.

Police found Trevor Bennett lying outside the home early Sunday morning with an apparent gunshot wound to the head. He was taken to a hospital.
Officers also found what they described in the affidavit as a "katana-like sword" and a sheath outside near the front door. A katana is a curved Japanese sword historically used by samurai.

What started as an argument escalated when Smith exited the home and returned with a "sword of some kind," the affidavit said. When the woman, whose first name is redacted from the affidavit, opened the door, Smith grabbed her by the throat and threatened her life, according to the affidavit.
"Ms. Bennett stated he (Smith) told her if she's not going to be with him, then she's not going to be with anyone," the affidavit said. "Ms. Bennett then told police she yelled for help."

Trevor Bennett ran upstairs from the home's basement with a 9mm Nano Beretta and told Smith he would shoot him if he didn't let go of his sister, according to the affidavit.
Smith allegedly then threw the woman to the ground and began fighting with Trevor Bennett. A few seconds later, the woman heard a gunshot, according to the affidavit.
The minor son Smith shares with the woman told responding officers he had heard his parents argue earlier that day.
The boy told officers that as he helped his mother when she was on the ground, he saw his father and his uncle get into a fight. Then he saw his father, while lying on his back, shoot his uncle in the head as he was standing over him, according to the affidavit.
The woman and her son told police they didn't know how Smith grabbed a hold of Trevor Bennett's gun.

After the incident, Smith fled, according to the affidavit. He was arrested the next day.
Smith was also charged with one count of aggravated burglary in relation to the incident. He is being held at the Hamilton County Jail on a $150,000 bond and is due to appear before Hamilton County General Sessions Court Judge Lila Statom on Tuesday for a preliminary hearing, according to jail records.
